1.1 Account: a personal account that Users must have in order to use the Platform;
1.2 Advertisement: an advertisement on the Platform offering an Auction House Product;
1.3 Artwell App: Artwell's mobile application that allows Users to access the Platform and its services;
1.4 Artwell Website: Artwell's website, accessible via www.artwell.nl, through which Users and Auction Houses gain access to the Platform and the associated services;
1.5 Auction House: a company specialising in organising and facilitating auctions.
1.6 B2C Terms of Use: these terms and conditions, applicable to the use of the Platform by Users. In addition to these Terms of Use for Consumers (B2C), there is also a set of Terms of Use for Auction Houses (B2B);
1.7 Content: texts, images, image recordings or other forms of information and data posted on the Platform;
1.8 General Terms and Conditions: the https://www.artwell.io/legal/terms-and-conditions applicable to Users;
1.9 Platform: the Artwell Website and the Artwell App and the services associated with the use of this Website and the App;
1.10 Products: the goods offered for sale through the Platform;
1.11 Users: consumers using the Platform via the Artwell App or via the Artwell website;
2.1 Artwell is a Platform. The Platform has been established by Artwell B.V., located at Loosdrechtse Bos 19, Hilversum (the Netherlands) and registered with the Dutch Chamber of Commerce under Chamber of Commerce number 91266092 ('Artwell').
2.2 These Terms of Use apply to Users using the Platform Artwell.
2.3 These Terms of Use apply to the use of the Platform Artwell by Users with effect from 24-10-2025. By using this Platform, you unambiguously agree to these Terms of Use.
3.1 In order to use Artwell's services via the Artwell App, Users must create an Account.
3.2 When creating an Account, Users must provide their first and last name, phone number and email address. By providing their telephone number, Users consent to communication via electronic means, including WhatsApp
3.3 Users are obliged to provide accurate and up-to-date information when creating an Account. If the information provided is found to be incorrect or incomplete, Artwell reserves the right to block or delete the Account of the relevant User.
3.4 Users can cancel their Account at any time via the settings in the Artwell App or by contacting Artwell at: support@artwell.nl.
4.1 Artwell is a Platform on which Users can create an Account that allows them to develop their taste in art or other Products offered by Auction Houses. By swiping images of art and other luxury products to the left (don't like) or right (do like), Artwell can develop a profile of the relevant User, and what the User may be interested in purchasing.
4.2 Users can also purchase these Products offered by Auction Houses. Through the Artwell App, Users can get in touch with Auction Houses. If they wish to purchase one of the Products offered, they can make a bid for it at the relevant Auction House.
4.3 Artwell reserves the right to add third-party auction and bidding functionalities to the Artwell App and/or to the Artwell Website.
4.4 Basic use of the Artwell App is free for Users. Artwell reserves the right to add certain features (in the Artwell App behind a payment wall.
4.5 Payments for Products offered via the Platform take place outside the Artwell App and outside Artwell.
4.6 Users are and remain solely responsible for the use of the Artwell App through their Account and the bids made from their Account.
4.7 Users must ensure that they do not make excessive use of the Artwell App, or use the Artwell App in a way that causes or may cause network overload and/or nuisance to other Users.
5.1 Use of the Platform is restricted to Users aged 18 or older only, unless permission for use has been given by a legal representative. By using the Platform, you declare that you are at least 18 years of age or older, or have the consent of a legal representative.
5.2 The Platform reserves the right to deny access or cancel a User's Account if it appears that a User is under 18 years of age.
6.1 Complaints about the Platform or Artwell's services can be submitted via the contact form on the Platform or by email to: support@artwell.nl.
6.2 Artwell aims to address and resolve complaints within 14 days of receipt.
7.1 Artwell reserves the right to amend these Terms of Use at any time.
7.2 Amendments will be announced via the Platform (Artwell App and Artwell Website) and take effect immediately.
7.3 If Users do not agree to amended conditions, they must cease using the Platform and delete their Account.
8.1 These Terms of Use are exclusively governed by Dutch law.
8.2 All disputes arising from or related to these Terms of Use shall be submitted to the competent court in the district where Artwell is located.
9.1 The provisions of these Terms of Use may only be deviated from with Artwell's prior written consent.
9.2 Insofar as translations of these Terms and Conditions of Use are available and the Dutch text of the Terms and Conditions of Use or of special terms and conditions of sale deviates from the text of the relevant translation, the provisions of the Dutch text will prevail.
9.3 Any invalidity, annulment or nullity of one or more provisions of the Terms of Use shall not affect the validity of the remaining provisions. If any provision of the Terms of Use is void or annulled, Artwell will apply a substitute provision that is legally permissible and, to the extent possible, consistent with the intent and content of the original provision and the other provisions of the Terms of Use.
